Abstract

Perkembangan teknologi digital telah mendorong meningkatnya pemanfaatan karya cipta di ruang digital, sekaligus memperluas praktik pelanggaran hak cipta melalui situs web. Sebagai respons terhadap hal tersebut, pemerintah Indonesia menerbitkan kebijakan penutupan situs web pelanggar hak cipta sebagai instrumen kebijakan di ruang digital. Namun demikian, meskipun kebijakan tersebut telah diterapkan selama hampir satu dekade, tingkat pelanggaran hak cipta justru menunjukkan tren peningkatan. Penelitian ini bertujuan untuk menganalisis tantangan implementasi kebijakan penutupan situs web pelanggar hak cipta di Indonesia melalui pendekatan Systematic Literature Review (SLR). Penelitian ini menggunakan metode kualitatif dengan menelaah 25 artikel jurnal yang dipublikasikan dalam rentang waktu 2016-2025 dan diseleksi melalui basis data Scopus dengan mengacu pada pedoman PRISMA. Hasil penelitian menunjukkan bahwa tantangan implementasi kebijakan mencakup ketidakselarasan antara kerangka regulasi dengan praktik pelaksanaan, keterbatasan efektivitas kebijakan, rendahnya kepatuhan pengguna, serta ketidakpastian keberlanjutan kebijakan dalam jangka panjang. Temuan ini menunjukkan bahwa kebijakan penutupan situs web belum sepenuhnya mampu menjawab kompleksitas pelanggaran hak cipta di ruang digital. Oleh karena itu, penelitian ini merekomendasikan pendekatan kebijakan melalui penguatan koordinasi kelembagaan, pengembangan ekosistem konten legal yang lebih terjangkau bagi masyarakat, peningkatan literasi digital dan edukasi publik, serta melakukan evaluasi kebijakan secara menyeluruh.
