Abstract

Kriminalitas dalam ruang tradisi adat Kecamatan Sampolawa, Kabupaten Buton Selatan merupakan fenomena berulang yang tidak dapat dilepaskan dari dinamika budaya lokal. Tradisi joget yang seharusnya menjadi arena euforia kolektif dan pertukaran simbolik justru kerap berubah menjadi ruang lahirnya tindak kekerasan situasional. Penelitian ini bertujuan menganalisis pola kriminalitas dalam acara joget serta mengkaji respons masyarakat melalui mekanisme penyelesaian berbasis adat. Metode yang digunakan adalah penelitian hukum empiris-normatif yang mengintegrasikan analisis bahan hukum primer dan sekunder mencakup peraturan perundang-undangan, hukum adat, jurnal, dan literatur kriminologi dengan data lapangan berupa wawancara mendalam dan observasi langsung. Hasil penelitian menunjukkan bahwa tindak kriminal yang terjadi merupakan produk interaksi antara euforia kolektif, konsumsi alkohol, anonimitas sosial, dan melemahnya kontrol sosial informal. Data Polsek Sampolawa mencatat 51 kasus kriminal periode 2021-2026, dengan pola fluktuatif yang berkorelasi dengan intensitas penyelenggaraan acara joget. Masyarakat lebih memilih penyelesaian melalui musyawarah adat sebagai wujud keadilan restoratif lokal yang menekankan pemulihan harmoni sosial. Studi ini menegaskan pentingnya pendekatan integratif yang memadukan hukum positif dengan kearifan budaya lokal dalam penanganan kriminalitas berbasis konteks.
