GCR: Sebuah Harapan Bagi Masalah Waktu Tunggu Pengungsi di Indonesia

Artikel ini bertujuan untuk menganalisis potensi GCR dalam mengurangi masalah waktu tunggu pengungsi di Indonesia untuk menuju ke negara ketiga dan peran UNHCR terhadap potensi pemberian kepastian waktu tunggu bagi pengungsi di Indonesia untuk menuju ke Australia dan Kanada sebagai negara ketiga penampung pengungsi dari Indonesia. Artikel ini menggunakan pendekatan perundang-undangan dan pendekatan konseptual, serta menggunakan sudut pandang teori transnational legal process untuk menganalisis pergeseran ketentuan hukum pengungsi internasional dari hard law hingga soft law serta diinternalisasi ke dalam kebijakan nasional Australia dan Kanada. Hasil penelitian ini menemukan bahwa, terdapat adanya potensi penyelesaian masalah waktu tunggu pengungsi di Indonesia dengan pengimplementasian GCR yang jelas dan terukur, yang dapat mengurangi ketidakpastian waktu tunggu pengungsi di Indonesia untuk menuju ke negara ketiga. Jaminan target penerimaan pengungsi oleh pemerintah Australia dan Kanada menjadi titik balik bagi isu pengungsi di Indonesia untuk mendapatkan waktu tunggu yang dapat diprediksi. UNHCR memiliki peran dalam mengkoordinasikan dan mengawasi pelaksanaan target penerimaan pengungsi oleh Australia dan Kanada dalam rangka memberikan kepastian waktu tunggu bagi pengungsi di Indonesia untuk menuju ke negara ketiga.
